DatStat's Survey Participant Privacy

DatStat, Inc. (“DatStat”) is a research company that has been commissioned by the sponsor of this survey (the “client” or “survey sponsor”) to collect survey responses. The client retains sole ownership of all survey data, including any identifying information you provide. DatStat does not sell, share or distribute your data or any identifying information provided by the client to facilitate contacting you to invite your participation in this survey.

This policy demonstrates our firm commitment to online privacy. DatStat maintains generally accepted industry standards for confidentiality and security throughout all phases of the survey selection and assessment process and is a participant in the US Department of Commerce Safe Harbor initiative. This document provides an overview of DatStat’s privacy policies and practices.

Safe Harbor DatStat is dedicated to meeting all Safe Harbor requirements as they relate to the collection and use of personal information collected and/or received from: a) research participants or b) client organizations for use in implementing and/or hosting a survey a commissioned by the survey client.

Choice DatStat does not disclose any personal information, whether collected through the survey process or provided by the client, to any other third parties except as required by law or as authorized by the client. Please refer to Onward Transfer (below) for information regarding the transfer of data to companies working on our behalf. We may also be directed to transfer data to additional vendors as directed by the client organization.

Cookies DatStat’s survey software provides survey clients with the option of enabling cookies on anonymous or unauthenticated surveys. In the case of anonymous or unauthenticated surveys, no identifying information exists to allow a survey participant to restart a partially completed survey.Sponsors have the option of enabling a cookie which consists of a small amount of data that is sent to your browser from DatStat’s web server and is stored on your computer's hard drive to track a survey session and allow you to resume a partially completed survey at a later time. The cookie can also prevent multiple survey submissions from the survey participant’s computer. If you reject cookies, you may still participate in a survey.

Onward Transfer DatStat will not transfer personal information to any third party working on our behalf unless the third party agrees to be bound by the same principles and standards DatStat upholds. Prior to the disclosure of data to any third party working on our behalf, DatStat requires said third party to execute a written Confidentiality and Non-disclosure Agreement (CNDA). The CNDA sets forth the confidential nature of data collected and transferred and restricts the third party working on our behalf from releasing information to any other parties.
Security DatStat follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. DatStat takes the following security precautions when storing/using personal information:

  • For survey participants, secure servers with registered site certificates provided by VeriSign Internet Trust Services provide for advanced encryption over the wire.
  • DatStat takes strict precautions to ensure that no unauthorized individuals have access to DatStat facilities.The servers that house our web surveys reside in a restricted access facility. Firewalls separate the data from the website and the Internet. This facility is monitored by security on a 24x7 basis.

Survey Results The survey sponsor retains sole ownership of the survey data and identifiers. Survey responses are stored in a secure location. We only allow survey results to be downloaded by authorized users identified by the survey sponsor. DatStat technical support and development may examine these data at the request of the client for support and troubleshooting purposes. We have security measures in place to protect your results while stored on our servers and we will prosecute any attempt to access this information without authorization to the fullest extent of the law.

Email Notification System Our email notification system stores your email address on our server in a secured location. These email addresses are kept on the server for tracking and click notification purposes. Much like survey data, the survey sponsor retains sole ownership of these addresses and other identifiers. DatStat technical support and development may examine these lists for support and troubleshooting purposes. We will not use or sell these email addresses to anyone.

Data Integrity Data integrity is of the utmost importance to DatStat. Any survey used to collect data on the DatStat systems has gone through extensive testing before survey launch to verify the data is being collected and reported correctly. Any files sent to DatStat by a client contact are checked for reasonableness to the extent possible. Ultimate responsibility for the reliability of data sent by a client contact lies with the client.

Access Personal information is provided to DatStat by some of our clients. Survey participants should contact the survey sponsor to verify and update their personal information if not correct. Any data entered by a respondent is assumed to be correct. Individuals can change their answers prior to submitting a survey, but once a survey is submitted, the information collected is assumed to be correct.

Enforcement DatStat considers enforcement of the Safe Harbor Privacy Principles to be key to our privacy commitment. Any complaints should be sent to the mailing address or email address above (see Notice). DatStat will investigate any and all complaints, and take appropriate action where necessary if violations of the Safe Harbor Privacy Principles are found. Any inquiries or complaints will be responded to in a timely manner, and a member of our staff will follow up on all issues to make sure they are handled appropriately.

In the event that DatStat and the client cannot come to an agreement to resolve a dispute regarding data that is subject to this Privacy Policy, DatStat agrees to have the Direct Marketing Association (DMA) serve as the independent third-party recourse mechanism. 

Safe Harbor and EU Data Protection Requirements


Safe Harbor provisions are terms and conditions as set forth by the International Trade Federation of the United States Commerce Department that promote data security and protection and procedures to ensure that the terms and conditions are adhered to and supported by those companies who have agreed to the terms and conditions of Safe Harbor and have formally certified to that effect. DatStat, Inc. has met the Safe Harbor requirements on 10/12/07 and has been placed on the Safe Harbor list of companies accordingly. This list and details on the Safe Harbor provisions may be found at: http://web.ita.doc.gov/safeharbor/SHList.nsf/WebPages/Washington. This certification is provided solely by the International Trade Federation of the United States Commerce Department and is not a certification by the TRUSTe program.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website.

If we decide to change our privacy policy, we will post those changes to this privacy statement and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here or by means of a notice.
